Tenants & occupiers
Tenancy rights, responsibilities and estate administration.
Grupo Gosen manages tenancies as part of long-term ownership. The relevant tenancy, lease, licence or occupational agreement determines the rights and obligations applying to each property or parcel of land.
The landlord relationship
Occupation is governed by the agreement, the title and applicable law.
Grupo Gosen owns and manages land and property for long-term investment purposes. A tenancy is therefore treated as part of the continuing management of the underlying asset: the occupational agreement, rent, condition, permitted use, repair obligations, access arrangements, insurance position, estate infrastructure and future management of the property are considered together.
The exact legal relationship differs between assets. Occupation may arise under a residential tenancy, business tenancy, agricultural tenancy, farm business tenancy, licence, grazing arrangement, allotment or amenity licence, storage agreement or another form of occupational document. The terminology used on this website is general. The signed agreement and applicable law take priority.
Grupo Gosen maintains records of its occupational interests and expects tenants and occupiers to comply with the covenants and conditions attaching to their occupation. Equally, the group administers landlord obligations that arise under the agreement and law, including responsibilities for matters retained by the owner.
Long-term ownership depends on clear communication. Tenants should identify the property or land precisely when raising an issue, provide the relevant tenancy reference where available and explain whether the matter concerns rent, repair, access, alterations, use, assignment, subletting, notices, safety, boundaries or another estate issue.
Grupo Gosen as landlord
Rights commonly retained by a landlord.
The rights applying to a particular property depend on the relevant agreement. Where reserved or granted, Grupo Gosen may exercise landlord rights including the following.
Rent and other sums
The right to receive rent, licence fees, insurance contributions, service or maintenance contributions and other sums properly due under the occupational document.
Enforcement of covenants
The right to require compliance with tenant covenants concerning use, repair, occupation, alterations, assignment, subletting, nuisance, statutory compliance and other agreed restrictions.
Access and inspection
Rights of entry, inspection or access where the agreement or law permits, normally subject to any notice requirements, purpose limitations and protections applying to the occupier.
Protection of the asset
The right to act where occupation, disrepair, unauthorised works, unlawful use, nuisance or other conduct threatens the condition, legal position or value of the property.
Consent controls
The ability to grant, refuse or condition consent where the agreement requires landlord approval for alterations, change of use, assignment, subletting, signage, works or other controlled acts.
End-of-term rights
Rights relating to expiry, break rights, surrender, renewal, possession, dilapidations or reinstatement where provided by the agreement and subject to the statutory regime applying to the occupation.
Rent and payment
Payment obligations are part of the asset-management framework.
Rent and other contractual payments are administered in accordance with the relevant agreement. A tenant should not assume that one property follows the same payment structure as another: payment dates, review provisions, indexation, service contributions, insurance arrangements, VAT treatment and other financial terms can differ materially.
Where a payment is overdue, Grupo Gosen may take the steps available under the agreement and applicable law. Those steps can include reminders, contractual interest where validly provided, recovery action or other remedies. Remedies involving possession, forfeiture or termination are subject to the legal safeguards and procedural requirements applicable to the particular tenancy.
If a tenant believes an amount has been demanded incorrectly, the appropriate course is to raise the matter promptly through the contact form, identifying the property, the demand and the reason for the query. A dispute about one sum does not necessarily suspend other contractual obligations.
Repairs and condition
Responsibility is allocated by the tenancy and by law.
Repair obligations can sit with the landlord, the tenant or be divided between them. In rural and commercial property, tenants may carry significant repairing obligations. In residential property, statutory duties may impose obligations on the landlord regardless of the wording used in the tenancy. Agricultural arrangements can contain their own allocation of responsibility for buildings, boundaries, drainage, fixed equipment, cultivation and husbandry.
Grupo Gosen expects occupiers to report matters that could cause material damage, create a safety risk, affect adjoining land or compromise estate infrastructure. Early reporting helps prevent minor defects becoming expensive failures and allows the relevant contractual responsibility to be identified.
Where the tenant is responsible for repair, maintenance or reinstatement, Grupo Gosen may require the obligation to be performed to the standard required by the agreement. Where the owner is responsible, access may be required for inspection, survey, contractor attendance or works.
Consent and approval requests
Where landlord consent is required, provide enough information for a proper property and legal review.
Identify the property
Provide the full address, estate or parcel description and the name of the tenant or occupier.
Describe the proposal
Explain the proposed alteration, assignment, subletting, use, installation, access arrangement or other matter requiring consent.
Supply documents
Include drawings, specifications, contractor information, planning details, licences, proposed assignee information or other supporting material where relevant.
Allow review
The request may require review of the tenancy, title, insurance, planning position, estate impacts and professional advice before a decision is made.
Document the outcome
Where formal consent is required, approval may need to be recorded by licence, deed, letter, side agreement or other document rather than informal correspondence.
Use and conduct
Permitted use and estate covenants matter throughout the occupation.
Tenancies and licences often restrict how land or buildings may be used. Restrictions can protect the physical asset, neighbouring occupiers, estate infrastructure, environmental interests, insurance arrangements or planning position. A use that appears minor operationally can have legal consequences if it falls outside the permitted use or requires regulatory consent.
Grupo Gosen may enforce covenants relating to nuisance, waste, unlawful activity, unauthorised development, storage, access obstruction, boundary interference, subletting, assignment, signage, animals, cultivation, tree works, drainage, hazardous materials or other matters where those covenants apply.
Nothing on this page varies a tenancy or grants consent. A tenant should obtain written approval where the agreement requires it before carrying out the relevant act.
Tenant and occupier questions
What rights does Grupo Gosen have as landlord?
+
The rights depend on the agreement and applicable law. They can include receiving rent, enforcing covenants, inspecting or entering for specified purposes, controlling alterations or dealings that require consent, protecting the property, recovering sums due and using contractual or statutory remedies where obligations are breached.
Can Grupo Gosen enter a tenanted property whenever it wishes?
+
No general right should be assumed. Any right of entry depends on the tenancy and applicable law and may require notice, a specified purpose or other procedural protections. Emergency situations can be treated differently.
Can I alter, assign or sublet without asking?
+
Only if the relevant agreement permits it. Many tenancies require prior written consent. The wording of the particular covenant determines whether consent is absolute, qualified or otherwise regulated by law.
What happens if a covenant is breached?
+
Grupo Gosen may seek compliance and may use remedies available under the agreement and law. The appropriate remedy depends on the breach, the tenure and any statutory protections.
Does this page replace my tenancy agreement?
+
No. This page explains Grupo Gosen’s general management approach. The signed tenancy, lease or licence and the law applying to it govern the legal relationship.
